  • $500 Pathway Consultation credit if previously paid and documented

Scope of Services

1.- The representation includes up to fifteen hours of attorney legal work for a complex federal firearm-rights restoration matter; eligibility, timing, and presumptive-disqualifier analysis; deeper review and organization of the available record; document-acquisition planning; character-reference and supporting-evidence strategy; preparation or substantial revision of the federal application; development of an accurate, carefully crafted factual and legal narrative addressing difficult facts, presumptive disqualifiers, rehabilitation, public-safety considerations, or other material issues; multiple internal reviews; final package review; and routine administrative responses to reasonable Department of Justice requests for clarification or additional information, together with reasonable status follow-up during initial processing. Where appropriate, the presentation will be organized to create a clear administrative record of the issues raised and the support offered, which may be important if later judicial review is separately considered.

2.- This service does not include the filing or prosecution of a lawsuit, judicial review, appeal, administrative hearing, a new application after denial, state-law restoration, expungement, pardon, or clemency proceedings, or legal work beyond the included fifteen-hour allocation unless separately agreed in writing. Preparing a record that is clear enough to support later review does not mean that an appeal or judicial-review proceeding is included in this flat fee. No particular agency treatment, processing time, or result is guaranteed. Neither we nor the government guarantee eligibility, a processing time, a favorable determination, or the removal of any federal or state firearms restriction. You must not acquire or possess a firearm or ammunition based solely on retaining us, purchasing a service, or preparing or filing an application.

Flat Fee and Expenses

3.- The fee for the entire limited scope stated in paragraph 1 is $5,000.00, payable in connection with this engagement. It is a flat fee, not a fee contingent on approval. It covers reasonable and ordinary services within the selected scope, regardless of time spent. The advance payment will be deposited in an attorney client trust account and transferred only as earned through performance of the agreed services. It is not nonrefundable or earned upon receipt. If the representation ends before completion, any unearned portion will be promptly refunded based on the reasonable value of services performed, subject to the prohibition on a clearly excessive fee. For purposes of accounting for work completed upon early termination, Attorney Root's hourly rate is $350.00; this rate does not convert the agreed flat fee into hourly billing or permit charges above the flat fee for work within scope. We will provide an accounting on request and at termination. The total flat fee for Ultimate Federal Restoration is $5,000. If Client previously paid $500 for Pathway Consultation and that prior payment is documented and applicable to this later engagement, the $500 will be credited toward the $5,000 total fee, leaving a $4,500 balance. The total Ultimate Federal Restoration fee remains $5,000; the credit reflects the prior Pathway Consultation payment.

4.- The flat fee does not include government charges, record-retrieval charges, fingerprinting, certified copies, postage, or other third-party expenses. We will explain and obtain your authorization before incurring any such expense on your behalf; any advance for expenses will be safeguarded in trust and applied only when incurred. Additional legal work or fees require a new written agreement before that work begins.

Client Cooperation and Decisions

5.- You agree to provide complete and accurate information and requested records promptly, review any analysis, recommendations, application materials, or other work product provided to you for accuracy, and keep us informed of changes to your contact information or circumstances material to the matter. You decide whether to submit any application. We will not knowingly submit or assist in submitting false or misleading information. We will keep you reasonably informed about material developments within the selected scope, respond to reasonable requests for information, and explain matters sufficiently to permit informed decisions. Information relating to your representation will be protected as required by the rules of professional conduct, subject to applicable law and your authorization for disclosures needed to perform the selected service.

Completion and Termination

6.- Unless ended earlier, this limited representation concludes when the included application preparation, complex narrative and record-development work, final package review, and routine initial-processing assistance are complete, or when a final agency decision is received and forwarded to you. Any litigation, judicial review, appeal, new application, state-law proceeding, or other work outside this scope requires a new written agreement. You may discharge Attorney Root at any time. Attorney Root may withdraw only as permitted by applicable professional-conduct rules, with reasonable notice and steps reasonably practicable to protect your interests. On termination, we will promptly provide papers and property to which you are entitled, account for funds, and refund any unearned advance fee. Nothing in this letter limits any duty imposed by applicable professional-conduct rules.

If these terms are acceptable, please sign and return a copy of this letter.

Sincerely,
Felon Justice
