The § 925(c) Application Checklist: Documents to Gather Before You File

A strong firearm-rights restoration application begins long before the submit button. The new federal process requires records that can take time to locate, especially when convictions or residences span several states.

Quick answerStart with certified or reliable court records, sentence-completion evidence, criminal histories for the required period, residence history and character-reference information. Do not wait until the application opens to learn that a record is missing.

1. Identify every federal prohibitor

An application should begin with the exact legal reason or reasons the person is currently prohibited. A mistaken assumption here can send the rest of the preparation in the wrong direction.

2. Get the case file basics

  • Indictment, information or charging instrument
  • Judgment, plea or verdict documents
  • Sentencing order
  • Discharge or completion records
  • Any later expungement, set-aside, pardon or restoration order

3. Build the residential and criminal-history record

DOJ requires state criminal records covering a defined lookback period and places where the applicant lived. The official instructions should control, because the required coverage and accepted documents can change.

4. Plan for references

The federal rule contemplates character references. The best references are people who can truthfully speak to the applicant’s reputation, stability, conduct and life after the disabling event. A reference should never be coached to say something untrue.

5. Fingerprints and filing logistics

DOJ currently says electronic fingerprints must be submitted through the USPS process after the application is initiated. Follow the current instructions at the time of filing rather than using an old fingerprint card or third-party process that may not be accepted.
