Can a Felony Be Expunged? The Eligibility Questions That Matter Most

Whether a felony can be expunged is not answered by the word “felony” alone. Modern record-relief statutes often use a detailed eligibility matrix based on offense type, sentence, time passed and subsequent history.

Eligibility often turns on the statute of conviction and sometimes on the underlying facts. Violent offenses, sex offenses, offenses involving vulnerable victims and serious driving crimes are commonly treated differently.

What sentence was imposed?

Some laws distinguish jail from prison, probation from incarceration, or misdemeanor-level sentencing from felony-level sentencing. Completion of restitution and financial obligations may also matter.

How long has it been?

Waiting periods may run from conviction, discharge from probation or completion of the entire sentence. A later conviction can restart or eliminate eligibility in some jurisdictions.

How many convictions are on the record?

States vary widely on numerical limits. Some have expanded eligibility to multiple convictions; others remain restrictive. Automatic-clearing laws may also operate differently from petition-based relief.

What is the goal?

If the real objective is firearm rights, professional licensing or immigration relief, a generic expungement may not deliver the desired result. The strategy should be built backward from the legal consequence the person needs to change.
